TERMS OF SERVICE / SALES & DELIVERY CONDITIONS

1. Purpose and Scope
 
These Terms of Service (“Terms”) apply to all sales and delivery of products and services provided by Booksauna AS (“Seller”) to the customer (“Buyer”).
The Terms apply unless otherwise agreed in writing and take precedence over any terms proposed by the Buyer.
 
Norwegian law, including the Norwegian Sale of Goods Act and the Consumer Purchases Act, applies in addition to these Terms.
 
 
2. Services and Products
 
Booksauna AS offers, among other things:
•Rental of sauna experiences
•Wellness-related services and add-ons
•Products and services related to private events, groups, and corporate customers
 
The specific content of each order is stated in the booking confirmation or agreement.
 
 
3. Prices and Payment
 
•All prices are listed in Norwegian kroner (NOK).
•Prices for private customers normally include VAT; prices for business customers usually exclude VAT unless stated otherwise.
•Payment must be made according to the agreed method and deadline.
•Late payments will incur interest in accordance with the Norwegian Late Payment Interest Act.
•Seller may require advance payment when booking.
 
Seller reserves the right to adjust prices in the event of unforeseen cost increases, where justified and agreed.
 
 
4. Orders and Agreement
 
•The agreement becomes binding once the Buyer receives a booking confirmation or written order confirmation from the Seller.
•Seller may reject an order if capacity is lacking or if errors, omissions, or circumstances beyond the Seller’s control occur.
•Buyer is responsible for providing accurate contact and booking information.
 
 
5. Delivery and Access
 
•Services are delivered at the agreed time and location.
•The Buyer is responsible for providing access, space, and any necessary preparations required for delivery of the service.
•Any hindrance to delivery caused by the Buyer is at the Buyer’s risk.
 
 
6. Use of Services and Safety
 
The Buyer must comply with all safety instructions provided by Booksauna AS, including but not limited to:
•Safe and responsible use of the sauna and related equipment
•Avoiding use under the influence of alcohol or drugs
•Ensuring supervision of children and minors
•Not modifying or tampering with equipment
•Informing all participants of safety rules
 
The Seller may suspend or stop a service if the Buyer or participants pose a safety risk.
Such suspension does not entitle the Buyer to a refund.
 
 
7. Damage and Liability
 
•The Buyer is responsible for any damage to equipment, property, or surroundings caused by misuse, negligence, or lack of supervision.
•The Seller may claim compensation for damage beyond normal wear and tear.
•The Seller is not liable for personal injury resulting from improper use, violation of safety instructions, or use under the influence of alcohol or drugs.
 
 
8. Cancellation Policy
 
Private Customers:
•Cancellation ≥ 72 hours before the booking: no charge
•Cancellation 24–72 hours before: 50% of the agreed price
•Cancellation < 24 hours before: 100% of the agreed price
 
Business Customers:
•Separate cancellation terms may apply; if not specified, the above rules apply.
 
If extreme weather or safety conditions require cancellation by the Seller, the Buyer is entitled to rescheduling or a refund.
 
 
9. Complaints (Claims)
 
•The Buyer must notify the Seller of any defects or issues within a reasonable time.
•The Seller has the right to correct the issue or re-deliver the service if possible.
•If the issue cannot be resolved, the Buyer may be entitled to a price reduction or cancellation in accordance with Norwegian law.
 
 
10. Right of Withdrawal (Consumers)
 
For private consumers, the Norwegian Right of Withdrawal Act applies where applicable.
The right of withdrawal does not apply to:
•Services scheduled to be delivered before the withdrawal period ends and where the consumer has expressly agreed to waive the withdrawal right
•Custom-made or individualized products
•Services already completed by the Seller
 
 
11. Privacy Policy
 
Booksauna AS processes personal data in accordance with GDPR and the Norwegian Personal Data Act.
Details are available in the company’s privacy policy.
 
 
12. Force Majeure
 
The Seller is not liable for delays or failure to deliver caused by circumstances beyond the Seller’s control, including but not limited to:
natural events, extreme weather, accidents, fire, pandemics, strikes, supplier issues, or government restrictions.
 
In such cases, the agreement may be postponed or cancelled without liability for compensation.
 
 
13. Limitation of Liability
 
•The Seller’s total liability is limited to the amount paid by the Buyer for the relevant service or product.
•The Seller is not liable for indirect losses such as loss of profit, operational downtime, data loss, or third-party claims, unless mandatory law provides otherwise.
 
 
14. Governing Law and Dispute Resolution
 
•These Terms are governed by Norwegian law.
•Disputes should first be attempted resolved through dialogue and negotiation.
•If unresolved, disputes may be brought before the ordinary courts, with the legal venue being the Seller’s business location, unless mandatory consumer protection rules require otherwise.
